People sometimes ask me about a motion for discovery. A motion for discovery is just a request for a copy of or at least an opportunity to view all of the state’s evidence against you before the trial. Discovery is very important. It is the only way that you and your lawyer can evaluate the state’s case. Without discovery, it is impossible for your attorney to advise you about your chances of success at trial or whether you should plead guilty or accept a plea agreement.
